I got a used car from an international studnet, she had told me that she did smogcheck but she acually did not do it… and she asked me to do smogcheck, and i did it but the car i bought did not pass the smogcheck and i went to a repair company then i was told that it costs $1500 to fix it( to pass the smogcheck).
According to DMV the responsibility of the seller to provide a valid smog certificate at the time of delivery of the vehicle. There is no provision in the law to sell a vehicle "as is." Therefore the seller is always responsible for the smog certificate even if they mention the car is sold "as-is" because the law doesn’t recognize the "as-is" policy. The buyer has the option of paying for any repairs necessary to get the car to pass the Smog Check but may end up taking the seller to Small Claims Court to recover their costs.
I asked her to pay this, but she refuse it. I wanna sue her but the problem is she went back to her country. What should i do?
